Court ruling against the anti-terrorist wall

International Court of Justice in The Hague issued its ruling against the wall being built in Israel against terrorist infiltration.

Background: During the past four years over 1000 people were killed by Arab terrorists who infiltrated into Jewish communities and massacred innocent civilians including women and children. Over a year ago the government of Israel decided to build a concrete wall barrier separating the Jewish communities from the areas populated by Arabs in Judea and Samaria.

The construction of the wall was discussed in the United Nations (UN) and on December 10, 2003 the Secretary General of the UN, referred the following question to the International Court of Justice in The Hague.

"What are the legal consequences arising from the construction of the wall being built by Israel, the occupying Power, in the Occupied Palestinian Territory, including in and around East Jerusalem, as described in the report of the Secretary General, considering the rules and principles of international law, including the Fourth Geneva Convention of 1949, and relevant Security Council and General Assembly resolutions?"

The court ruling noted that "construction by Israel of a wall in the Occupied Palestinian Territory and its associated regime are contrary to international law".

Our views and comments on the question and ruling:

1. Israel is not an occupying power. The Land of Israel as outlined in the Bible has been promised by G-d the Almighty to the People of Israel. Modern State of Israel is reconstructing the homeland of the Jewish People who were exiled from the Land over 2000 years ago. By G-d's grace Judea and Samaria was liberated from Arab-Jordanian occupation during the Six Day Way in 1967.

2. The construction of the wall was supported by the Leftist establishment in Israel, who forced the decision for its construction. G-d fearing people in Israel opposed construction of the wall with the main argument that the Land of Israel should not be split by an artificial wall, as the whole Land belongs to the People of Israel. From a practical point of view the wall is going to prove to be a futile attempt to block infiltration of Arab terrorists, as they will discover new ways to overcome it, just as they found ways of excavating tunnels in Gaza Strip to smuggle explosives and armaments from Egypt. The only solution to the conflict is encouraging Arab people to leave the Land of Israel. The billions spent on wall construction should be spent to relocate Arab population to Arab countries where they belong (See Arab-Israeli Conflict: Basic Facts).

3. The court in its ruling ignored totally, Israel's right to defend its citizens from daily massacres by Arab homicide terrorists. This is similar to the silence of the world in the face of Jewish massacres in Europe and Asia, during the past century that culminated in the Holocaust. So nothing has changed much. The world bodies continue to provide sanction to Jewish massacres and provide sanctuaries to terrorists. The court was not expected to reach a different decision. At least two of the judges on the court are Arabs as judged by their names, Al-Khasawneh, and Elaraby.

4. Out of 15 judges, only one, Judge Buergenthal (from the USA) opposed the decision who submitted a differing point of view:

"... he believes that for the Court to reach such conclusion with regard to the wall as a whole without having before it or seeking to ascertain all relevant facts bearing directly on issues of Israel’s legitimate right of self-defence, military necessity and security needs, given the repeated deadly terrorist attacks in and upon Israel proper coming from the Occupied Palestinian Territory"

Conclusion: We hope that Israel will stop building a wall that cuts through the Holy Land, and will start dealing with the real threat of Arab occupation of this Land.

Rockets fired from Gaza kill a man and his grandchild and injure 14

This morning at 8:30 Arabs from Gaza fired two Kassam rockets one of which fell within 5 meters of a Kindergarten in the city of Sderot in Southern Israel. The rocket killed a 49-year-old man and his four-year-old grandchild and injured at least 14 people (full story). This attack once again illustrates that all the attempts by the Israeli government to achieve peace with the Arabs are doomed to failure. To remind the readers, the Oslo agreement was signed by the leftist government of Israel with the declaration to bring peace. Since then the people of Israel have known nothing but greatest level of terrorist activity against civilian targets.

During the last week 13 Israeli soldiers were killed while hunting for terrorists in the Gaza strip. Comments: The world media is depicting the current action in the Gaza strip as a fight of Israel against innocent civilians. So we bring below some recent pictures of innocent Palestinian civilians strolling in the streets of Gaza. Source of the pictures is news images at yahoo.com . Incidentally, yahoo.com has published 100's of photographs of youth killed by explosives in Gaza mob. They have not published a tenth of this for over 1000 people killed and many thousands more maimed and permanently injured by homicide bombers in Israel. Apparently the picture of a dead Jew is not worth publishing!
